Feb. 25, 2010 - PRLog -- The BOP's 500-hour Residential Drug Abuse Program (RDAP) is the only corrections-based Program in which BOP inmates can participate and receive up to 1 year time off (‘early release') of their sentences and 6 months of RRC (halfway house) placement .  See 18 U.S.C. § 3621(e).  In March of 2009 the RDAP Program rules were revised and the BOP added significant hurdles to an already overly prescribed and burdened Program.  In general, the Program’s early release benefits are now ‘tiered’ and the maximum early release benefits (12 months) are now only eligible to individuals with sentences of 37 months or greater.  The Program’s tiered system now provides as little as six months early release benefits for certain shorter lengths of sentences.  Compounding matters, there are long waiting lists at many institutions and RDAP is now essentially unavailable for individuals with less than 24 month remaining on their sentences at the time the opportunity to participate does arise.  To further compound matters, institutions in many judicial circuits make ineligible for early release benefits inmates who may have received certain 'enhancements’.  The mere judicial recommendation for RDAP does not within itself mean that the actual benefit of a sentence reduction will be realized.  It will take coordinated effort and the obtaining and dissemination of real time information to maximize opportunities.  Now more than ever there is a need to supplement criminal defense teams with knowledgeable and experienced prison consultants who are familiar with the system and how to navigatate its many intricacies.
