The Attorney General of California can establish this level of lead based on scientific consensus or can use a level that has been set forth in a consent agreement . In 2004, some candy companies agreed to a settlement (consent agreement) under Proposition 65 that established a requirement in California for all candies to ≤0.1 ppm of lead .
