MetroPCS Wireless, Inc., (Case Number: 8:13-cv-00698- In this putative collective/class action lawsuit, the Account Service Representatives allege that MetroPCS violated, and continues to violate, the Fair Labor Standards Act and the New York Labor Law by failing to properly compensate them for overtime hours worked. Morgan and Morgan overtime attorney Andrew R. Frisch is representing the ASRs in an effort to recover unpaid wages for the overtime work they performed, but for which they did not receive the proper overtime pay. According to a federal law known as the FLSA, non-exempt employees are entitled to time-and-a-half pay for all hours worked over forty in a given workweek. New York’s Labor Law has similar provisions. All unpaid overtime claims filed by Account Service Representatives who currently work for MetroPCS, or who worked for MetroPCS within the last three (3) years anywhere in the United States, OR who worked for MetroPCS within the last six (6) years in New York, and who were not paid proper overtime are eligible to join the case.
