Elvis Presley Palm Springs Home Decision Made

The property owners aim to open up the home to the public once again. After ten years of legal squabbles the title is now clear and the problems of the past are fading. It's been a rocky road caused by former occupant Reno Fontana who lived on the property for a decade without making payments. The property owners are looking to establish new operations after Monday's court decision leaves the title free and clear.

PALM SPRINGS, CA - A decision by Superior Court Judge Richard Oberhold ended a long-running dispute over the Elvis Presley home in Palm Springs and has Elvis Fans hopeful the home will once again be accessible.

Elvis enjoyed his Palm Springs home as a convenient getaway from Los Angeles and quiet retreat from world performances. With the legal dispute settled, the present day owners are looking forward to re-opening the home at 845 West Chino Canyon that was owned by Elvis Presley for the last seven years of his life.

Elvis enjoyed his Palm Springs California home as a convenient getaway from Los Angeles and quiet retreat from world performances. This is not the Elvis Honeymoon Hideaway, a property which Elvis never owned and Elvis occupied only for a short while prior to his purchase of the Chino Canyon home.

In the Riverside courtroom plaintiffs Reno Fontana and his wife Laura Whittier failed to prove they had a case and were dismissed. Attorney Michael Rubin from Tarzana represented the defendants who were awarded attorney fees and court costs estimated to be in the range of $200,000.

The final decision from the five-day trial clears title and enables the property owners to move forward with plans to improve the property, potentially making it available to the public once more.

The home, nearby to John Wessman's stalled development, The Boulders, has a rocky history of controversy in the neighborhood over tour buses crowding the narrow road and contentious relations with Fontana. Fontana managed to produce a series of holiday and special events generating income from the property after obtaining the first Event House Permit from the City of Palm Springs.

Fontana and Whittier got involved with the property in 2003 by entering into an agreement with investor Herman Jaehne who put up the money to purchased the property from a Japanese businessman who held the property in suspense for the previous seventeen years. During those seventeen years the property was closed up and unavailable to the public.

When Fontana did not come through with the money he promised Jaehne was left in a financial bind that pushed the property towards default. An out of court settlement between Fontana and Jaehne opened the door for relief in the form of Fontana's Palm Desert neighbor Rade Raicevic who came forward with funds to pay off Jaehne. Those funds were also provided by Adrian Van Rijs with Financial Bonanza.

Fontana again failed to make mortgage payments (almost $9,000 month) and once more the property headed into default on April 1, 2007. To stall foreclosure Fontana and Whittier filed a series of seven bankruptcies tying up the property and preventing eviction. In October 2010 they filed suit against Financial Bonanza, claiming an illegal foreclosure.

On January 17, 2013 Riverside County Sheriffs evicted Fontana and Whittier from the property they had been occupying since 2003, without making payments.

A media conference is scheduled for Saturday, July 27 at 2:00 P.M. In attendance will be winning attorney Micheal Rubin and winning litigant, Rade Raicevic. There will be a presentation showcasing the title pedigree of the real estate. Photo copies of the property title signed by Elvis and Priscilla will be provided the media.

The Jergins [lotion] family originally built the home in 1946 by local architect Albert Frey. Title then passed to Ray Kroc of the MacDonalds restaurant fame, just prior to Elvis purchasing the property in 1970. After the passing of Elvis, the property was sold by Priscilla to singer Frankie Valli who then sold it to the Japanese businessman. The property was featured in a television show by Morton Downey Jr. in the 1990s focusing on the psychic vortex surrounding the property. The property was also featured in a video by Huell Howser.

This is a closed media event requiring pre-approval of press credentials. Media will be allowed unprecedented access to all parts of the property. The press conference starts at 2:00 P.M. sharp featuring Attorney Rubin. Immediately thereafter will be a short presentation by Raicevic with a question and answer period.
