Bisnar Chase Seeks Injunction to Stop Lorillard from Promoting Blu Products as Safe

NEWPORT BEACH, Calif. - May 5, 2015 - PRLog -- The Newport Beach personal injury law firm of Bisnar Chase is seeking an injunction against the Lorillard Tobacco Company to prevent the corporation from promoting its Blu brand of electronic cigarettes as safe and healthy under the Consumer Legal Remedies Act. Bisnar Chase filed a class action lawsuit in state court against Lorillard claiming that the company falsely advertises its Blu e-cigarettes as "safer," "healthier," and “smarter” to traditional cigarettes when they are not.

Consumer attorneys for Bisnar Chase filed a 50-page complaint on behalf of lead plaintiff Larry Diek in Orange County Superior Court stating that he would not have bought Blu e-cigarettes had he known about their dangers. The lawsuit claims that Blu falsely advertises its e-cigarettes as a safer, healthier and smarter alternative to traditional cigarettes because they emit harmless vapors

But, Diek states in his complaint that the vapor is in fact a concoction of toxic chemicals that are harmful to humans. Diek and his class members are seeking an injunction in order to stop Lorillard from promoting Blu products as safe, healthy, and smarter alternative under the Consumer Legal Remedies Act, and damages for unfair competition, deceptive advertising, and express warranty.

E-cigarettes are by no means harmless, said Brian Chase, senior partner at Bisnar Chase. The California Department of Public Health released a report stating that e-cigarette vapor has been found to contain at least 10 known carcinogens including formaldehyde, cadmium, benzene and lead.

"Objective studies do show that e-cigarettes contain carcinogens and other harmful substances that are found in traditional tobacco cigarettes. Just because it's vapor, doesn't mean it's harmless. The vapor, an aerosol, does emit substances that could cause cancer and other serious illnesses – to the user and to the people who are exposed secondhand."

Through an aggressive marketing and advertising campaign, Blu and other e-cigarette makers have given potential users a false sense of safety, Chase said.

"This is big tobacco all over again. The old cigarette companies advertised that four out of five doctors recommended Camel cigarettes. Now, Blu and other vaping products are hawking cherry, vanilla and other candy flavored e-cigs, literally inviting kids to smoke them. They're basically exploiting the public's lack of awareness regarding what these products really contain."
