DHS retracts I-9 Changes

A new I-9 Form was set to go into effect today, but in a surprise move, the Department of Homeland Security retracted the mandatory changes late on Friday, pending further comment and review.

Feb. 2, 2009 - PRLog -- Monday, Feb 2nd was scheduled as the deadline for replacing all previous I-9 forms with new version. Then late on Friday, the last business day before the deadline, DHS changed its mind and revoked the change.

In a move that has thrown Human Resource departments across the country into a state of confusion, the new I-9 forms are now out and the old I-9 forms are back in.
 
Businesses who have already received new forms and instructions must now postpone using them until the new April 3rd deadline. The older version is mandatory until that date.

The I-9 Form is mandatory for all new hires in the U.S. The new form reflected several changes in the acceptable documents employers could use to verify an applicant's eligibility to work. The final version of the new form had been released only about a week ago, leaving businesses scrambling to replace their soon-to-be expired form with an updated version. Today the scrambling continues as employment law companies and HR departments begin replacing forms thrown away last week.

G.Neil has the new materials, but will not ship further I-9 product until late March. Employers should continue to use the old form (with revision date of 6/5/07) until April 2. Employers who have already purchased the new I-9 should not use the revised form until April 3.
