U.S. Department of Commerce Retracts Previous Finding of Unfair Trade Against the Rubicon Group

Feb. 5, 2009 - PRLog -- The U.S. Department of Commerce has excluded the Rubicon Group from an antidumping duty order on frozen shrimp from Thailand, which was unfairly placed upon the company in 2005. The DOC published its decision to exclude Rubicon from the antidumping order in the Federal Register on January 16th, 2009, indicating that its original determination in 2005 was, in fact, in error.

According to the U.S. Department of Commerce, “dumping” occurs when imported merchandise is sold in, or exported to, the United States at less than the normal value of the
merchandise.

The DOC decision was made in response to a World Trade Organization ruling that found that the DOC used an illegal methodology to determine whether the Rubicon Group was dumping shrimp in the United States. This methodology improperly inflated the dumping calculation. The new determination now confirms that the Rubicon Group should have been excluded in the original investigation because its products were traded fairly and justly.
