Greenbelt, MD -- December 13, 2010 -- Loren Data Corp. filed a civil antitrust lawsuit against GXS, Inc. in the U.S. District Court in Greenbelt, Maryland, today, seeking injunctive relief and damages. As of June 25, 2011, the case is pending a Motion to Dismiss as submitted by GXS counsel, and the accompanying supplementary statement of law in response to the motion, submitted by plaintiff's counsel. The complaint charges that GXS has used its acquisition of IBM’s Internet Exchange service in 2005 and Inovis, Inc. in 2010 to gain majority market share in the Electronic Data Interchange communications market. GXS is accused of using this market position to shape this market by denying Loren Data Corp. comparable and competitive non-settlement network peering access which GXS grants to other Value Added Network operators such as Sterling Commerce, Easylink and NuBridges. The charges contained in the complaint also state that GXS has interfered in Loren Data’s line of business and global network EDI operations, damaging Loren Data’s brand and its ability to compete in the global supply chain communications market.
