June 27, 2011 - PRLog -- Plaintiff, a 53 year old truck driver, was operating his 18-Wheeler on Interstate 12 around Hammond when the defendant attempted to switch lanes and lost control of his passenger car.  The defendant’s vehicle struck the driver side rear wheels of plaintiff’s tractor and then became lodged under plaintiff’s trailer.  Plaintiff filed suit against the tortfeasor and against plaintiff’s Uninsured/underinsured motorist carrier.  The UM carrier asserted that the policy only provided $75,000 in UM coverage; however plaintiff argued that the selection of lower UM limits had not been done properly.  Plaintiff was ultimately successful in obtaining $1M in UM coverage.  As a result of the accident, Plaintiff sustained injuries to his neck and back.  MRIs revealed that Plaintiff suffered from severe degenerative disc disease and his treating physicians recommended that he undergo neck and back surgery.  Plaintiff underwent a cervical fusion followed by a lumbar fusion six months later.  The case was resolved for $830,000.00.
