Jan. 25, 2012 - PRLog -- Landlords often rent out their property to tenants for additional income and investment purposes.  Sometimes, the landlord owns the property outright, but more often, the landlord owes a mortgage on the property which he must pay each month.  Landlords often rely on the income received by the tenant in order to pay for the mortgage.  This makes for a difficult and unpleasant situation when the tenant suddenly stops paying the rent, even when a fixed-term lease is in place.

1. The tenant fails to pay the landlord.
2. A "3 Day Notice to Pay Rent or Quit" is issued.
3. If the tenant fails to pay within the specified time period, then an Unlawful Detainer (eviction) lawsuit is filed against the tenant in one of the Orange County courthouse that handles evictions for that area.
4. The eviction lawsuit is served on the tenant at the Orange County house.
5. If the tenant fails to respond within 5 calendar days to the Orange County eviction lawsuit (or slightly longer if the tenant cannot be personally served), then the landlord will seek a default judgment.  If the tenant responds within the 5 days, then a court date may be set to argue the case in the Orange County courthouse.
6. When the landlord “wins” the case, the proper forms will be filed and submitted to the sheriff who will forcibly remove the tenant from the property if the Orange County tenant does not voluntarily move.
7. Once the landlord has the property back in his possession, the landlord can change the locks and rent the house to new tenants.
