Litigation Continues in Transvaginal Mesh Cases

Transvaginal mesh litigation continue to move forward as depositions of top executives from Ethicon and Johnson & Johnson progress, reports Ennis & Ennis, PA
 
Sept. 26, 2012 - PRLog -- Litigation involving the nationwide claims of women adversely affected by transvaginal mesh devices continues to move forward.  Chief Judge Joseph R. Goodwin who is overseeing the MDL cases has recently scheduled a second set of bellwether cases for June 24, 2013.  An MDL was created to consolidate vaginal mesh lawsuits against manufacturers, C.R. Bard, American Medical Systems (AMS), Boston Scientific, Ethicon/Gynecare and most recently Coloplast. Judge Goodwin is overseeing all five MDLs in the U.S. District court for the Southern District of West Virginia.  The first set of bellwether trial is currently scheduled for February 5, 2013.  Bellwether trials are useful to attorneys as they are representative of how a jury is likely to respond and decide other similar claims.

In preparation for these upcoming trials, depositions of high ranking officials from Ethicon and its parent company Johnsons & Johnson are taking place, including those of Alex Gorsky, CEO of Johnson & Johnson, Gary Pruden, Group Chairman and Worldwide Franchise Chairman for Ethicon and former vice chairman of Johnson & Johnson, Sheri McCoy. The testimony form these depositions will be used as evidence in the upcoming trials, particularly pertaining to the continued marketing of these products in light of known complications.

In 2011, the FDA issued a warning that complications form vaginal mesh devices were “not rare” and that it had received nearly 4,000 complaints regarding the products. Such complaints included mesh erosion through the vagina, pain, infection, bleeding, organ perforation and urinary problems.
