Rear-end 18-Wheeler Wreck; $1M Settlement

BATON ROUGE, La. - Feb. 13, 2014 - PRLog -- Plaintiff, a 58 year old truck driver, was operating his vehicle on Highway 61 when he was rear-ended by an 18-wheeler.  Following this collision, the Plaintiff was diagnosed with a herniated disc in his neck.  As a result of this injury, the Plaintiff underwent a 2-level cervical fusion.  Following the surgical procedure, the Plaintiff experienced complications and an emergency tracheotomy had to be performed in order to open his airway.  An additional surgery was also performed in order to remove a blood clot which had formed in his neck.  The Plaintiff continued to experience symptoms in his neck and arms into the future and therefore he began to receive radiofrequency ablations to control his pain.

As a result of these injuries, the Plaintiff was unable to continue working as a truck driver and was ultimately fired by his employer.  At the time he was fired the Plaintiff was approximately two years from becoming vested in his pension plan, and therefore the Plaintiff lost nearly all of his retirement benefits.  The Plaintiff’s past medical expenses were approximately $130,000.00.  The defendants requested to mediate the case, however the Plaintiff refused.  Shortly before trial, the defendant insurer tendered their $1,000,000.00 policy limit.
