Court records show that the plaintiff was making a left turn at the intersection of Maryal and Bernal drives in Salinas, Calif. Court records showed that a Monterrey County jury decided in favor of the plaintiff awarding her $127,347 in damages. The verdict was entered on April 10. H. Gavin Long, trial attorney for BISNAR | CHASE said the insurance company for the defendant, Fred Loya Insurance, refused to pay $15,000, which was the insurance limit. "They questioned our client's need for shoulder surgery," he said. "They tried to argue that our client failed to yield the right-of-way when in fact it was the other driver who was making a left turn and was required to yield under the law. Our client was not speeding. She was traveling at 35 mph." Long said he is pleased with the verdict. "The insurance company could have paid our client $15,000, which was the insurance limit. In the end they ended up paying more than eight times." This is the length to which insurance companies will go to in order to prevent a payout, Long said. "Many of us think the insurance company is our friend in need. But, the reality is, they are in it to make money and they're not going to pile up profits by paying fair settlements. What this insurance company did was very typical." The satisfaction he gets out such cases is one of beating and exposing insurance companies, Long said. "Insurance companies put up quite a fight to save money. They will try different tactics to get away without paying. In the end, we got our client the money she needed for medical expenses and shoulder surgery. And that was extremely satisfying." Long, an Orange County native, graduated from the University of Southern California in 1996 and from Whittier Law School in 1999. He was a recipient of the American Jurisprudence Award for securing the highest grades in his study of Torts and Evidence. Long has a wide range of jury trial experience in cases from murder and fraud to medical malpractice in state and federal courts. Long has taken six personal injury cases to trial and has obtained verdicts above the defendant’s offer in all six trials, beat the plaintiff’s CCP 998 in three of the trials and "busted" the defendant’s insurance policy in three of the trials.
