Aston PA. (USA), April 30 -- Engineered Arresting Systems Corporation (ESCO), a wholly owned subsidiary of Zodiac Aerospace, filed suit on March 21, 2014 in the United States District Court for the Northern District of Alabama against Atech, Inc., Sang Shin, Kwae Shin, Philip Ahagen, Kim Guimarin, Scandinavian Manufacturing (SCAMA AB), and Harald Ahagen.

The suit (Case 5:14-cv-00518-MHH) claims, among other things, trademark infringement, unfair competition, and willful intent to trade on the goodwill associated with ESCO’s trademarks, by SCAMA AB, Vaderstad Sweden, whose principal owner is Harald Ahagen, acting with a front company called Atech, Inc. of Huntsville Alabama, which is controlled by Harald Ahagen’s son, Philip Ahagen, and others.

As background, the BAK-12 brand aircraft arresting system and the PORTARREST® P-IV brand mobile aircraft arresting system (MAAS) were jointly developed by ESCO and the U.S. Air Force. For the past 50 years, ESCO has been the only company to manufacture, distribute and sell those brands of arresting systems to the USAF and 80 other countries. Both products have benefited from continuous development and thousands of improvements based on extensive testing and field experience. ESCO is the undisputed owner of the designs of the latest specification BAK-12 and PORTARREST® brand systems operated at every USAF and NATO base. And by continuous and exclusive use, ESCO is the owner of the BAK-12 and PORTARREST® trademarks, and those trademarks have acquired distinctiveness as a symbol of the source of high quality products and services offered by ESCO and embody a valuable reputation and goodwill belonging exclusively to ESCO.

After a failed three-year attempt to gain USAF certification for its own BC-11 energy absorber, SCAMA/Atech is now using decades-old obsolete drawings and, without the permission or authorization of ESCO, pirating ESCO’s brand names and proprietary information, using them in a manner that is likely to confuse and deceive the public and potential purchasers of ESCO’s goods and services and damage ESCO’s substantial goodwill.
