Follow on Google News | Hughes Law Files Response to the Government’s Brief in Opposition to Motion to DismissMichael R. Hughes, Angela Brown’s attorney, has filed a response to the government’s brief in opposition to the motion to dismiss.
By: Hughes Law In their brief, the government argued that Mrs. Brown “sold” the medical cannabis to her son and thus should be charged with child endangerment. Mr. Hughes has repeatedly pointed to case law which indicates that this is not a sale under Minnesota and Federal law. The government maintains, but without any evidence to prove their claim, that Mrs. Brown’s actions in this matter were “dangerous and injurious” to her son. Mr. Hughes points out that the treatment was actually helping and that the only actions which are injurious or dangerous to the child are the government’s actions in this matter. Additionally, the government, in their brief, openly threatened the Brown family with other legal proceedings if there was any future treatment with medical cannabis by the Brown’s son. Finally, because of the possibility that the government will subpoena Mrs. Brown’s son to testify against her at trial and the emotional distress that would cause the child, Hughes Law will seek separate counsel for Mrs. Brown’s son to protect his interests, should this matter go to a jury trial. However, Mr. Hughes believes that he has presented strong legal arguments for the Judge to dismiss all the charges in this matter.
