Iconic® Brands’ Ceo Files Copyright Infringement Lawsuit Against Manufacturer Of Kah Tequila

 
LOS ANGELES - April 10, 2015 - PRLog -- City of Industry, CA (April 10, 2015) - As of March 11, 2015, Kim Brandi, the CEO and founder of Iconic® Brands (www.iconicbrandsinc.com) and the artist who created the Day of the Dead skull-shaped tequila, has filed a copyright infringement lawsuit against Fábrica de Tequila Finos, S.A. de C.V. ("FINOS"), manufacturer of KAH tequila, through the Mexican Institute of Industrial Property, Intellectual Property Protection Division (I.M.C. 1849/2014 (I-65) 18983).

Through two initial briefs and certificates issued by the Public Copyright Registry of Mexico, Brandi established her ownership over the packaging components of the following: the plastic work “SANGRE DE VIDA,” 03-2014-031412090200-01; the artwork “SANGRE DE VIDA,” 03-2014-031412460500-14; the sculptural work “CALAVERA,” 03-2014-031412501800-01; the artwork “SPIDER CALAVERA”, 03-2014-031412552300-01; the plastic work “DIABLO”, 03-2014-031412584700-01”; the plastic work “MUERTOS CALAVERA,” 03-2014-031412042800-01; and the plastic work “SPIDER CALAVERA,” 03-2014-031413185600-01.

As a result of this lawsuit, an injunction prohibiting the manufacturing, marketing and use of Brandi’s works consisting of skull-shaped bottles and various aspects of Day of the Dead artwork has been imposed against Fábrica de Tequilas Finos, S.A. de C.V. (“FINOS”).To enforce this order, cease and desist letters have been distributed to wholesalers and on- and off-premise accounts who continue to sell the protected works.
