NEWPORT BEACH, Calif. - May 6, 2016 - PRLog -- Personal Injury law firm Bisnar Chase has obtained a settlement for the family of two individuals who were killed in an SUV rollover crash in Fresno. According to court documents, the fatal accident occurred on the Interstate 5 in an unincorporated area of Fresno County in February 2013.

The driver lost control of the SUV when the tread separated from one of the tires. The vehicle rolled over and the roof caved in. The driver and his mother-in-law, who was rear seat passenger, died in the crash. They were both wearing their seatbelts. The terms of the settlement agreement are confidential.

The lawsuit, filed against the automaker, the tire manufacturer and the dealership where the vehicle was purchased, alleged that:

 The vehicle failed to protect its occupants because of a weak roof that lacked the structural integrity to protect the vehicle's occupants.

 The vehicle had a propensity to rollover due to its defective design.

 The SUV lacked the Electronic Stability Control safety feature, which might have prevented this tragic crash.

 The SUV lacked side-curtain airbags, which would have cushioned occupants during a violent rollover crash and prevented the fatal injuries.

 The tire was inadequately designed to not suffer catastrophic failure and tread seperation.

"It is always satisfying when we are able to not only obtain a settlement for those who have lost loved ones, but also when we are able to hold the manufacturer of the defective automobile and/or tire manufacturer accountable for making a product that did not protect consumers as it should have," said Brian Chase, senior partner at Bisnar Chase.

Government standards relating to roof strength are still extremely inadequate when it comes to protecting vehicle occupants, he said.

"In this case, the tire was defective, the vehicle was poorly designed, had a weak roof and didn't have safeguards such as electronic stability control and side curtain airbags," Chase said. "In a world where all this safety technology is available at relatively low costs, it is unacceptable for automakers to treat safety as an option."
