Construction App zlien Sues Nationwide Notice For Alleged Plagiarism Of Mechanics Lien Resources

NEW ORLEANS - June 20, 2016 - PRLog -- In an effort to defend its intellectual property rights, zlien filed suit in April 2016 against Nationwide Notice arguing that Nationwide plagiarized website content from zlien.com. The complaint alleges that Nationwide Notice copied educational content from zlien's website, where it is made available to the public at no cost, and displayed the information on their own website behind a paywall.

This is not the first time zlien has been forced to defend its intellectual property from alleged copyright infringement by construction notice businesses. In 2013, zlien filed similar copyright infringement lawsuits against the National Association of Credit Management (NACM), SunRay Notice, and RoHillCo under similar circumstances. Those suits settled out of court.

"Other construction notice companies, are looking to zlien because zlien is the authority. Our team deeply understands lien rights and the lien landscape," says zlien CEO Scott Wolfe, Jr. As a leading source for mechanics lien law information and construction payment resources, zlien regularly contributes articles to key industry publications such as CFMA's Building Profits, Construction Executive, Construction Business Owner, and more. In addition to Nationwide's alleged infringement of zlien's copyright, the displaying of content behind a paywall is directly opposed to zlien's mission of empowering a transparent and fair construction payment process. "At zlien, we believe that access to information on lien law should be available to everyone," says Wolfe, "Not behind a paywall."

When asked to comment further, Wolfe responded: "What does it say about construction notice services that they are not only apparently willing to plagiarize content like this, but that they seem to feel the need to?"

The litigation, captioned Express Lien, Inc. v. Nationwide Notice, Inc. et al. was filed on April 8, 2016, in the United States District Court for the Eastern District of Louisiana. The suit has Civil Action Number 16-02926.
