Support Free Speech Case Against Smithsonian After Supporting Berkeley Free Speech Case?Plaintiff in Smithsonian National Portrait Gallery Lawsuit Appeals To Attorney General Jeff Sessions To Stand With The First Amendment Free Speech Case Since D.O.J. Has Issued 'Statement Of Interest' in Anti-Conservative Berkeley Free Speech Lawsuit.
By: Julian Raven The letter of appeal sent to Attorney General Jeff Sessions reads as follows: "Dear Attorney General Jeff Sessions, May this letter find you well and may God continue to bless your service to our great and free Republic! It is with a mixture of joy and frustration that I write to you. I rejoice in the 'statements of interest' in the free speech cases made by the Department of Justice under your leadership. The ongoing proactive efforts to confront and resist the erosion of our precious constitutionally protected freedom of speech in our Nation's centers of higher learning, especially the recent case in Berkeley, California are just and timely. My frustration though is understanding how the Department of Justice in my case (17-cv-01240- The Department of Justice in my case has made ridiculous arguments in support of their Smithsonian government entity 'status' theory, protecting and exonerating Smithsonian officials from First and Fifth Amendment responsibilities, their arguments completely stripping me of my constitutional rights, whilst not even denying the egregious conduct of the Smithsonian officials. This obviously is disturbing and frustrating, since the Department of Justice should be defending the constitution and especially free speech! In the recent 'Statement of Interest' you write on page 2: "This case is before the Court on a motion to dismiss. Accordingly, the Court must accept all of Plaintiffs' well-pleaded allegations as true. See Bell Atlantic Corp. v. Twombly, 550 U.S. 544, 555–556 (2007). For purposes of this Statement of Interest, the United States also accepts Plaintiffs' allegations as true. The United States takes no view regarding whether Plaintiffs will succeed in proving these allegations at trial." My case is also now before the Court on a motion to dismiss. My case is for 1st Amendment 'free speech', 'viewpoint discrimination', 5th Amendment 'due process of law' and 'equal protection under the law' violations. My question is will the Department of Justice representing the United States accept as true my allegations and issue a 'Statement of Interest' regardless of the outcome of my case? My case(17-cv-01240- If this anti-Conservative, anti-Republican, anti-Christian and anti-Trump bias is allowed to persist and resist our very Constitution at the government run Smithsonian, which has become a seal and archive of America's knowledge and history, then the liberties and blessings the Constitution was meant to protect and guarantee will continue to be trampled by leftist ideologues in our government whose agenda is simply un-American! With this letter, I Julian Marcus Raven, citizen of these United States of America, appeal to you, Attorney General Jeff Sessions of the same United States of America, that you issue a 'Statement of Interest' in support of the Constitution and the 1st Amendment free speech issues involved in my pending case which is before the District Court of Columbia in Washington."
