The study shows that whiplash accounts for almost 70% of claims related to car accidents. Former President of the High Court, Nicholas Kearns has warned that there is a high risk of abuse of the personal injury claims process in Ireland because the system is very genuine in seeking to recompense victims of personal injury, and additionally because the risk of prosecution for fraudulent claims is so low. It is thought that part of the reason for the publication of the PIAB report is to shine a light on the personal injury claims process in Ireland, to understand if the system is being preyed upon by spurious claims, and to better correlate the damages with those available in other legal jurisdictions.
