Another Victory For The Cannabis Industry As Weedmenu Wins A Trademark Infringement Lawsuit In Federal Court.

LOS ANGELES - Nov. 25, 2019 - PRLog -- Weedmenu, an online information resource business, achieved a huge victory in federal court on November 18th 2019 against Virtual Support, LLC for trademark infringement, unfair competition, and false designation of origin. Weedmenu, which was launched in 2017 has stopped a company from 'stealing its thunder' as people race to get in the Cannabis Industry few catchy and relevant names remain unused in the industry. This has made people turn to using names that are already in use, which is illegal.

In a time when Branding is a huge part of business' success it makes sense for businesses to defend their brand and reputation Weedmenu has done just that. Though cannabis is not legal on the federal level yet, companies like Weedmenu have used the federal courts to defend and protect their trademark rights. This is becoming more common as the industry continues to legalize across the United States. The key takeaway from this complaint is that cannabis companies should be cautious when choosing branding, especially if inspired by or related to an already existing brand.  Additionally, brands and companies must be aware of potential misappropriations of their marks by new cannabis startups. Not only was this a huge win for Weedmenu but it's also a huge win for new cannabis businesses that are intimidated by the Federal Court system.  While Courts across the country continue to see and increase in cannabis related lawsuits some Courts are now accepting the fact that Intellectual Property in regards to the cannabis sector needs protection as well and they may  eventually need to use the Federal Court to seek that protection.

"While it was a rough battle for us, we fully understand that the fight has just begun and we will have to continue to watch the industry closely for any other cannabis business that will knowingly or inadvertently infringe on our trademark and or brand. Luckily for us we were able to defend without the use of an expensive IP lawfirm."

Says founder of Weedmenu, Octavio Sanchez, who defended his trademark in Federal Court as a Pro Se Litigant. Mr Sanchez wasn't new to the court system as he was first sued by a company called Ghost Management Group, LLC which they were able to come to a settlement agreement.

This is just the beginning of what awaits in the court system as others in the lucrative industry face challenges in protecting their trademark.
