These types of rentals often lead to complaints about noise, traffic, and other community violations because renters are unaware of the rules and expectations of the HOA or choose to disregard them. In turn, the homeowner may be held liable for violations from their renters.

"It is important for the HOA to be open and transparent with homeowners regarding the decision to implement rental restrictions," says Kuester. "Give homeowners the opportunity to voice their opinions and concerns so that the board can create appropriate policies. Discuss why changes are being made and how it can benefit the association and its members. It is also essential to consult with legal counsel regarding local, state, or federal rules around rental restrictions."
