Australian Skilled Migration Update: This New Proposed Law is "Great News" for Visa Applicants!

MELBOURNE, Australia - March 7, 2023 - PRLog -- he Department of Home Affairs will now consider a suitable skills evaluation that was acquired during the 60-day invitation period for the skilled migration applicant's selected occupation.

Highlights:
  • Now accepted are GSM skills assessments completed during the 60-day invitation period.
  • For skilled migration permits with a points requirement, a skills assessment is required.
  • Before filing an EOI, applicants are urged to set up a skills assessment.

The update states that candidates will be qualified to submit an application for a visa under the general skilled migration category.

How Does This Impact Possible Candidates?

For candidates who previously would have missed the chance to apply for the visa since their skills assessment validity expired when they got the invitation, this is "excellent news," according to Melbourne-based Immigration Lawyer, Ajay Sharma.

"Previously, you would not be allowed to lodge the legitimate application when you obtained the invite to submit the application and your skills assessment eligibility ended before the day you got the invite," he said.

According to Mr Ajay, who decoded the new advice, the modification now permits candidates to apply for a visa even if their skills evaluation has passed at the time of invitation.

For instance, if you submitted an expression of interest (EOI) with a current chef skills assessment but received a notice inviting you to submit an application for an 189 visa, your skills assessment has now expired.

In this example, you now have 60 days to acquire a legitimate skills evaluation and submit your application within that time range," he said.

Who Needs a Skills Evaluation?

Candidates seeking the following GSM visas that are subject to a points system must have an appropriate skills evaluation for the job they are applying for:
  • Skilled Independent visa (subclass 189)
  • Skilled Nominated visa (subclass 190)
  • Skilled Regional (provisional) visa (subclass 489)
  • Skilled Work Regional (provisional) visa (subclass 491)

Obtaining a Skills Evaluation

The appropriate evaluating authority for the applicant's chosen occupation must be contacted.

On the Department website, it is advised to "check which skills testing authority is the proper one for your specified occupation and schedule your skills assessment even before you file for the visa."
