A Statutory Claim is also known as a no-fault claim and compensation is paid regardless of who is at fault. All you need to prove to have an entitlement to a statutory claim is:
  • You are a worker – an employee
  • You've suffered an injury and your work was a significant contributing factor to that injury.

If you tick both of those boxes, you should be entitled to statutory WorkCover benefits.

A Common Law Claim involves negligence on the part of your employer. To have a successful claim you need to establish that your injury occurred at work and it occurred as part of negligence on the part of your employer. If you can establish liability and negligence then you are entitled to a lump sum award of damages.
