Follow on Google News | Novel Anti-Trans Lawsuit Filed; Another OpportunityMen [M2F transgender] in Women's Sports Is Illegal Consumer Fraud
It provides a unique opportunity for attorneys in other states to easily join in using legal action against a practice which is unfair, invades the privacy of female athletes, and is increasingly causing serious unnecessary injuries even in non-contact sports, says public interest law professor John Banzhaf. It charges that the NCAA is "engaging in false, deceptive, and misleading practices" in ways which are illegal under the law of Texas. Under this legal theory, the practices would also be illegal under the laws of many other states in which they could attacked with similar lawsuits, or by complaints filed with the state regulatory agencies which enforce consumer protection laws, says the law professor. Perhaps as important, the lengthy and well documented legal complaint can easily be copied using simple cut-and-paste techniques so that attorneys can file a similar one in their own states by making only limited changes in its actual wording. Moreover, as a alternative (or in addition) to a new lawsuit, the Texas legal complaint can be copied and filed as a complaint to a state regulatory agency. To make drafting a new lawsuit and/or agency complaint in other states very easy, Banzhaf has posted a copy of the Texas legal complaint on his website where the complete text can easily be copied and then filed with only minor changes: http://banzhaf.net/ Paxton wants the court to limit the participation of trans athletes in NCAA competitions if they take place in Texas or involve teams representing Texas. His lawsuit also hopes to stop the NCAA from labeling events as women's sports if they include [M2F] transgender women. http://banzhaf.net/ End
