Nov. 19, 2008 - PRLog -- Making a will can be a daunting process but the peace of mind given in having a valid will is invaluable. What’s more, your will is one of the most important documents that you will ever create. As a business owner it is vitally important to have an up to date will as, by making a will, you decide who will receive your hard earned property and possessions.

Ann Farnill, solicitor at Tallents says,

“Although by law you do not have to make a will, it is the best way to make sure your estate is passed to family and friends exactly as you wish. It can also help to ensure a smooth transition for your business. If you die without a will (intestate), your assets will be passed on according to the law, which may as a result leave loved ones in confusion, cause a delay and create extra cost.”

While you can write a will yourself, it is advisable to use a solicitor as there are certain formalities to follow to ensure that your will is valid. In addition, there are a large number of organisations who now claim to be able to supply you with a will but most are not regulated by law.  Help the Aged recommend that “a will should be drafted by a solicitor or suitably qualified accountant or bank officer whose business is regulated by law.”

Ann comments,

“Using a qualified professional will ensure that your will is legally valid and is unique to your individual circumstances.”

Using a solicitor needn’t be expensive. It is worth remembering that the costs of using a professional can be much less than having to unravel an invalid will or deal with an estate where no will was made.

The cost of writing a will can vary between solicitors and will depend on how complicated your affairs may be. It is worth mentioning that solicitors often provide a fixed quote for the cost of your will at the outset therefore there are no hidden costs in your bill.
