The "Age of Entitlement" is to Blame for the Substantial Cost of Pre and Post-Nuptial Agreements

In his bimonthly column, Mark B. Baer, Esq. states that the fact that we are living in the “Age of Entitlement” creates a great deal of risk to any attorney involved in pre & post-nuptial agreements.

Jan. 16, 2011 - PRLog -- Los Angeles Family Law Attorney Mark B. Baer claims that "according to the statistics, an increasingly large percentage of the population is entering into such agreements. Yet ironically, fewer and fewer attorneys are willing to handle them." Baer states that such agreements are challenged so regularly because "we are living in the 'Age of Entitlement,' where narcissism has become epidemic, and people do not wish to take responsibility for their actions."

"Unfortunately, approximately 50% of marriages end in divorce today, at which time the spouse who would be better off financially without the prenuptial or post-marital agreement will frequently challenge the enforceability of the agreement," says Baer. "This reality creates a great deal of risk to any attorney involved in drafting and negotiating prenuptial or post-marital agreements." He says that as a result, "an attorney who charges less than $10,000 to handle such matters is foolish.... While that may seem like a lot of money for each party to spend... it is one of the unfortunate consequences of the fact that we are living in the “Age of Entitlement.”

A family law attorney in Houston, Texas comments, "Your article is right on. We have been drafting premarital agreements for about 30 years. It is truly a niche specialty. We even use declaratory judgments to confirm validity of the agreements before marriage or before funding in case of a marital agreement." A family law attorney in San Diego, California writes, "Very thoughtful insights." A family law attorney in New Jersey adds, "I will turn away a client if he or she only wants me to 'sign off' on a prenuptial agreement that someone else has prepared, without making any substantive suggestions."
