By: The Federalist Society for Public Policy Studies The Supreme Court's recent decision on Obamacare has raised concerns regarding whether the courts will enforce federalism in the future. Many now believe that enforcement of federalism will be achieved through the political, and not the judicial, process. Professor Samahon will discuss how the Seventeenth Amendment to the Constitution, which established the direct election of United States Senators by popular vote, has influenced federalism, the separation of powers and money in politics. He will also discuss the consequences of the amendment and the path back to restoring the political enforcement of federalism.
