Official case records show that the female employee worked for a specialty pet retail company as a dog camp manager in California. She was described as a responsible and hardworking employee with strong work ethic and outstanding employment record until she was discriminated against in various instances by her manager and co-workers. Records said that the woman employee announced her pregnancy to her manager sometime in August 2010. The manager told the employee that she had suspected about her pregnancy but had hoped that it was not true. The employee was shocked with the unwarranted disapproval of the manager. Consequently, the manager began to treat her differently; In one particular event, the manager asked the employee’s associates to evaluate her performance. The said evaluation had raised certain issues that needed to be addressed. The employee asked the manager to discuss the result of the performance evaluation but she refused. The incident caused the former to suffer from constant anxiety and fear. In August 2010, the discrimination and harassment experienced by the employee prompted her to contact the company’s hotline to lodge a formal complaint. In response to the filed complaint, the company’s district manager contacted the employee and explained that her troubles were caused by personality conflict between her and the manager. Consequently, the employee was subjected to further discrimination and harassment. Official records added that on August 26, 2010, a loss and prevention investigator working for the company interrogated the employee concerning an accusation that she was planning to open her own dog day camp and/or pet boarding facility. The employee was also accused of soliciting customers for the said venture. However, since the employee was pregnant that time, her husband was unemployed, and has a four-year-old son, the idea of her starting a new business was highly unlikely. Nonetheless, the interrogation continued. After the four-hour interrogation, the employee began experiencing shortness of breath and anxiety that she could not help it but cry. Meanwhile, the harassment against her continued with the daily monitoring of her activities at work. The manager would enter the employee’s department on an hourly basis and offer harsh criticisms. The employee was subjected to strict monitoring, something that she did not experience prior to announcing her pregnancy. In one instance, despite knowing that the employee is pregnant, the manager would require her to close and clean the facility after work hours. The employee requested to be exempted from such duties because inhaling harsh chemicals could be harmful to her unborn child. However, instead of favoring her simple request, the employee was asked to present a doctor’s note. Eventually, the employee found it impossible to comply with all of the manager’s demands. On November 6, 2010, the employee was suddenly fired from the company. Consequently, she continued to experience severe emotional and psychological distress after her termination. Records said that she suffered extreme anxiety and mental distress. Meanwhile, the actions done by the manager and other employees clearly violated the rights of the employee with respect to prohibition on pregnancy discrimination as provided by both California state and federal laws.
