Attorney Bernard Walsh Comments On The Florida Texting While Driving Ban

BRADENTON, Fla. - May 9, 2013 - PRLog -- The amended bill known as SB 52 proposed by State Senator Nancy Detert from Venice, managed to pass the Florida House Representatives and is ready for Governor Rick Scott to sign into law. However the bill has been widely criticized as not having any teeth and watered down to the point where it will be ineffectual.

"At our law firm we see the results of texting while driving everyday. Time and time again the Florida legislature has failed to pass a law while the citizens are put at risk on our roads. SB52 was yet another failure by the Florida legislature. This bill has been watered down to the point of being ineffectual. Texting while driving has been made a secondary offense meaning an officer cannot pull over and cite a drive caught in the act unless they are violating another law. In addition texting at a stop light is permitted, and should an officer actually be able to prove a driver was texting while driving after they have been pulled over, the fines are so weak that they are not an effective deterrent. Because of the weakness of this bill, the injuries and deaths caused by texting while driving will continue to plague our state.”
