Colorado DUI Defense Attorney Timothy R. Bussey Discusses DUI Lab Testing Tampering Allegations

DUI defense attorney Timothy Bussey was recently featured by news stations KRDO and KWGN to comment on allegations that the supervisor of a Colorado DUI testing lab had tampered with evidence, putting thousands of drunk driving convictions in doubt.
 
COLORADO SPRINGS, Colo. - Aug. 27, 2013 - PRLog -- Colorado DUI defense lawyer and founder of The Bussey Law Firm, P.C. provided legal insight into evidence showing that the head of the Colorado Department of Public Health and Environment toxicology lab had a bias against drunk driving defendants and potentially tampered with refrigerated blood samples. As such, thousands of DUI convictions have been questioned and could be overturned. It was also found that workers at the lab were inadequately trained in blood alcohol content testing.

In an interview with KRDO, attorney Bussey said, “This is significant for all Coloradans, regardless of whether they have been charged with a criminal case or not because it goes to the fundamental fairness of our criminal justice system. Clearly a laboratory shouldn’t be taking sides. It’s just simple science.”

Colorado defense attorneys, including Timothy R. Bussey, are calling on the governor to look into the matter. In a public address reported by KWGN, attorney Bussey said, “The question we really need to be asking is ‘How many cases did this affect? And if it starts there, does it move on to some other area of law?”

While the supervisor in question retired in May 2013, questions are still being asked concerning convictions made with evidence from the lab.
