Woman Receives $1 Million Settlement in a New Jersey Slip & Fall Case

MORRISTOWN, N.J. - Nov. 27, 2013 - PRLog -- Bergen County, NJ – In Kapidzic v. McCormick & Schmick’s Seafood Restaurant, a woman who was allegedly left disabled after a fall at McCormick & Schmick’s Seafood Restaurant was paid $1 million on Sept. 12 to settle the Bergen County lawsuit.

In the suit, Mersija Kapidzic claimed that in October of 2009 she had slipped on a slippery floor at McCormick & Schmick’s located in the Riverside Square in Hackensack and landed on her back. As a result of the fall, she suffered lumbar herniations, had to undergo surgery and was ultimately deemed totally disabled by the Social Security Administration, which means that the agency determined that her medical condition was “severe” because her condition significantly limited her ability to do even the most basic work activities.

In the suit, Kapidzic asserted negligence and premises liability claims, claiming that McCormick & Schmick’s had known about earlier falls at the site. In response to Kapidzic’s allegations, the restaurant denied liability and attributed her injuries to a prior car accident and a degenerative condition, said her attorney Todd Leonard of Leonard & Leonard, P.A.

On Aug. 8, the parties settled in mediation with retired Superior Court Judge Anthony Sciuto for $1 Million Dollars.
