Walsh of the Bradenton FL, Injury Law Firm Shapiro Goldman Babboni & Walsh reacts to federal regulators pushing to end the sale of vehicles with unfixed recall issues.
By: Shapiro Goldman Babboni & Walsh The current laws do not require sellers to get recalled vehicles repaired before selling them. Further auto dealers are not even required to notify car-buyers that the vehicle has been recalled and needs to be repaired. Officials from the NHTSA have stated that earlier efforts by lawmakers to require full disclosure on the matter of outstanding recalls have been stifled by strong opposition from automakers, dealers and the U.S. Chamber of Commerce. However, given the sheer number of safety recalls and the severity of the potential injuries from defective parts such as the Takata Air Bags, regulators have renewed the push for auto-sellers to fix or disclose any recalls on vehicles for sale to potential buyers. Attorney Bernard F. Walsh of the Bradenton Florida personal injury law firm Shapiro Goldman Babboni and Walsh responded to the latest push to strengthen consumer safety by stating,”As an attorney working with those injured in crashes from all walks of life I can say most people would be surprised that auto dealers are not even required to disclose that preowned vehicles have been recalled never mind that they are not required to repair the vehicle either. The current policy exposes the public to the risks of driving a defective automobile – risks that will eventually catch up with someones family or loved ones. Additionally the policy of not requiring dealers to disclose the need for a vehicle to be repaired is counter-productive for the automakers themselves, as the more defective vehicles are on the road, the more likely injury or death will result from that and that liability will be brought to the manufacturers. More importantly though, is that the current rules make it legal for dealers to knowingly sell defective vehicles to customers and allow those people to travel the roadways in an unsafe vehicle. I fully support the NHTSA's efforts to end this loophole and urge supporters of the auto industry to do the right thing.” About Attorney Bernard Walsh A highly experienced, AV Rated attorney, and Founder of the Manasota Trial Lawyers Board, Bernard Walsh is an active member in multiple legal organizations including The Association of Plaintiff Interstate Trucking Lawyers of America (APITLA), the Multi-Million Dollar Advocates Forum, the Florida Justice Association and the National Trial Lawyers Association.
