WASHINGTON - Feb. 5, 2025 - PRLog -- Daryl Guberman, a 40 plus year quality expert aerospace and other industries, has uncovered serious violations of federal law by Boeing, the American National Standards Institute (ANSI), the American National Accreditation Board (ANAB) also NADCAP- Performance Review Institute, and multiple federal agencies, exposing a longstanding cover-up regarding Boeing's failure to conduct proper supplier audits.ANSI-ANAB are founders of the (IAF) International Accreditation Forum incorporated in Delaware. It is an association of accreditation bodies national and international equivalent in accreditation to ANSI-ANAB in conjunction with IAF sister organization the (ILAC) International Laboratory Accreditation Cooperation In Australia. ANSI-ANAB are underwriters for IAF-ILAC.This means they take all systematic and product failure (liability).

This scandal stems from two key Boeing documents—the April 2002 NADCAP Special Process Supplier Notification and the July 2002 Supplier Bulletin (PQIT-02-00)—which revealed that Boeing intentionally avoided direct, on-site supplier audits, choosing instead to rely on third-party accreditation's from  NADCAP. ANSI-ANAB (AS9100)  have deep financial entanglements with federal agencies such as the DOJ, DHS, FAA, FDA, and Department of Commerce (NIST) and other federal agencies and corporations..

After Guberman exposed these documents during the April 17, 2024, DHS Subcommittee meeting https://www.newstribune.com/photos/2024/apr/18/3749044/, Boeing removed them from its supplier portal in early January 2025, erasing 23 years of public access, strongly suggesting an effort to destroy evidence of its wrongdoing. Removal of ANSI-ANAB- Management Committee  webpage, where organizations such as Boeing was a committee member who could grant, suspend and withdraw certifications from registration companies. Boeing's Policy of Avoiding Supplier Audits: A Breach of Federal Safety Laws

The two key Boeing documents revealed:
  • April 2002 NADCAP Special Process Supplier Notification – Boeing stated that it would only conduct additional audits "as the need arises." This vague language allowed Boeing to circumvent mandatory safety oversight for over 20 years.SEE PHOTO # 3

  • July 2002 Supplier Bulletin (PQIT-02-00) – Boeing explicitly stated that its On-site Boeing (audit) of suppliers quality system "if need be" "preference is to deal with proven suppliers with excellent quality performance and not have to do on-site quality system audits." This effectively eliminated Boeing's direct role in supplier oversight, violating federal laws requiring due diligence in defense and commercial aerospace manufacturing. Boeing's actions not only violated safety standards but also breached multiple federal laws designed to prevent fraud, protect aviation safety, and ensure accountability in government contracting.

False Statements (18 U.S.C. § 1001
):
  • Boeing knowingly concealed critical supplier oversight failures from the FAA, DOD, and DHS by relying on third-party audits while misleading regulators. .        Fraud Conspiracy (18 U.S.C. § 371):
  • Boeing, in conjunction with ANSI-ANAB, & NADCAP engaged in systemic fraud by possibly falsely certifying that suppliers met quality and safety standards without conducting direct audits.
         Wire Fraud (18 U.S.C. § 1343):
  • The financial transactions between Boeing, ANSI-ANAB, and federal agencies involved fraudulent misrepresentations regarding supplier certifications, potentially violating federal wire fraud statutes.
        Procurement Integrity Act (41 U.S.C. § 2102):
  • The DOJ, DHS, FDA, and Department of Commerce (NIST), as both members and paying customers of ANSI/ANAB, engaged in conflicts of interest, violating federal procurement laws designed to ensure unbiased regulatory oversight.

  • ANSI paid DHS official Phil Mattson $262,000 in addition to his federal salary and NIST official Gordon Gillerman $120,000, raising serious legal questions regarding unlawful financial incentives that compromised oversight integrity.
.        Federal Aviation Act (49 U.S.C. § 44704):
  • Boeing's failure to properly audit suppliers and its reliance on flawed third-party certifications violated FAA regulations governing aircraft production safety.
.        Obstruction of Justice (18 U.S.C. § 1519):

         Government Organization and Employees (18 U.S.C. § 208):
  • Federal employees participating in matters where they have a financial interest violated conflict-of-interest laws. The DOJ, DHS, FDA, and Department of Commerce(NIST) pay ANSI/ANAB for services while also sitting on their boards.
         Defense Production Act (50 U.S.C. § 4501 et seq.):
  • Boeing's failure to properly vet defense suppliers may have jeopardized national security by allowing non-compliant parts into military aircraft, missiles, and space systems.
        Regulatory Capture: How the DOJ, DHS, and FAA Colluded with ANSI-ANAB

The corruption extends beyond Boeing. The DOJ, DHS, Department of Commerce (NIST), and FDA are not only ANSI/ANAB board members but also paying customers, meaning they regulate the same organizations they financially support. This level of regulatory capture has created an environment where aerospace manufacturers, including Boeing, evade scrutiny while maintaining fraudulent certifications.

The American National Standards Institute (ANSI) and American National Accreditation Board (ANAB) are also the underwriters of the International Accreditation Forum (IAF) incorporated in Delaware and its sister organization the International Laboratory Accreditation Cooperation (ILAC) (Australia) —meaning they assume legal responsibility for failures in supplier oversight.

Daryl Guberman Calls for Criminal Investigation & Congressional Oversight

Daryl Guberman is calling for a full-scale criminal investigation into:

1.          Boeing's deletion of critical audit documents following the DHS hearing.

2.          Why Boeing was allowed to avoid direct supplier audits for over 20 years.

3.       The DOJ, DHS, FAA, and Commerce Department's NIST conflicts of interest          with ANSI- ANAB

4.     Potential criminal charges for fraud, obstruction of justice, and violations of aviation    safety laws.

5.      Immediate congressional action to strip Boeing of its ability to self-certify aircraft safety.
