Burwell, being orchestrated by a conservative libertarian group is claiming that the law only grants the Federal Government the authority to provide subsidies for people that live in states that have developed their own so called insurance exchanges. The core of the plaintiffs strategy is based on language within the law itself, and if the court rules in the plaintiffs favor, would with one stroke make health insurance coverage unaffordable for more than 8 million Americans, as well as cause an insurance “death spiral” as families are forced to cancel their plans they cannot afford to pay without the assistance. The mass cancelation of insurance plans would move the financial burden of paying claims for the very sick, now spread across a growing pool of more than 11 million ACA enrollees, to only those people who either live in a state with a state run exchange or can afford to make the insurance premiums. The practical effect of a SCOTUS ruling in the plaintiffs favor will be to force the majority of Obamacare enrollees to leave the insurance pool and causing the law to fail. Additionally this would bring chaos to the health insurance market as insurance companies must adjust plans to a new reality that includes millions of customers gone overnight. Much higher premiums will likely result and millions of people will once again be uninsured.
