Mesriani Law Group Hands $400,000.00 Settlement Win to Pedestrian Accident Victim

April 25, 2012 - PRLog -- Los Angeles – A recent development in one of the many personal injury cases handled by Mesriani Law Group resulted in the award of $400,000.00 settlement to Shahin Shakhani and her spouse, for a pedestrian versus vehicle accident case against defendant Arous Gillchrest.

Records show that on July 8, 2010, Shakhani was walking at the marked crosswalk on a green light, southbound on Church Lane and Sunset Blvd., when defendant, who was then traveling southbound on Church Lane, suddenly made an unsafe right turn, heading westbound on Sunset Blvd.  As a result,   defendant collided with the rear left side of the vehicle in front of her.  The impact then caused defendant to lose control of her vehicle, hitting Shakhani in the process.

The incident was corroborated by an eye witness, who declared that defendant caused the incident when she failed to control her vehicle and yield to pedestrian’s right of way.
After investigation, police authorities who were summoned to the scene of the incident confirmed that defendant caused the collision when she violated California Vehicle Code 22107 (Turning Movements and Required Signals), which provides that:

           “22107.  No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement.”

Furthermore, defendant even admitted that the incident was her fault when she declared in the police report that instead of stepping on the brakes, her foot slid over and pressed on the gas pedal, resulting in the incident.
