Client Survives Summary Judgment - Quest for Commission Continues

NEW YORK - Dec. 16, 2019 - PRLog -- Imbesi Law represents a real estate agent who alleges that while working as an independent contractor with Compass, her team leader failed to properly compensate her on two separate real estate transactions. Imbesi Law's client alleged three causes of action in her complaint filed in early 2018 - breach of contract, quantum meruit and unjust enrichment.

Defendant filed a motion for summary judgment, alleging that there were no issues of material fact. Imbesi Law's client opposed the motion, arguing that there were several issues which should be for a jury to decide.

On December 12, 2019, the parties appeared for oral arguments before Judge Louis Nock of the Supreme Court of the State of New York, Judge Nock issued his decision from the bench and denied Defendant's motion for summary judgment, agreeing with Imbesi Law that there were remaining material issues of fact.

As a result of the Court's decision, Imbesi Law's client can proceed with her case and continue to try to recover against the Defendant for unpaid commission.
