MINEOLA, N.Y. - Feb. 11, 2022 - PRLog -- Gregory S. Gennarelli, LLC is pleased to announce a recent settlement in the amount of $865,000.00 for a 61 year old teachers aid, for the NYC Department of Education, who slipped and fell on a wet bathroom floor caused by a leak in the ceiling. The incident occurred in the bathroom of her own apartment and immediately after using the shower. As a result of her fall, our client sustained an injury to her neck and a burn to her arm which was caused by an unprotected steam heating pole.

The defendants in the case, the owner and management company of a Bronx apartment building, disputed the claim and argued that our client fell while stepping out of the shower and onto a tile bathroom floor which lacked a bath mat. They further claimed that there was no leak in the ceiling, and that  they had never received any complaints of a leak in our clients bathroom. We were prepared to demonstrate that not only was there a longstanding and recurrent leak, but that patchwork repairs performed demonstrated that they were aware of the leak and had attempted to repair it. In addition, we were prepared to offer testimony that our client, and other residents of the apartment over the years, had made multiple complaints to the superintendent and management company (as recently as days before the incident) and the landlord took no action to inspect, investigate the cause or repair the condition.
