MINEOLA, N.Y. - Dec. 31, 2023 - PRLog -- n a Medical Malpractice case brought on behalf of an infant plaintiff, an Obstetrician and Midwife Practice agree to a settlement of $2,000,048, with an expected total payout in excess of $4,396,000.

The case involved the prenatal care and treatment of the infant's mother, which resulted in the premature birth of an infant at just 31 weeks gestation. As a result, the infant suffered developmental delays.

Upon learning of her pregnancy, the mother returned to an obstetrician and midwifery practice that she was familiar with, and had cared for her during her previous pregnancies, each of which resulted in preterm births. Since she had prior preterm births, the mother was at high risk of another preterm delivery.

Preterm birth is considered to be any live birth prior to the completion of 37 weeks gestation. According to the American College of Obstetricians and Gynecologists, in an effort to prevent preterm delivery in women with a singleton pregnancy, and a documented history of preterm delivery, weekly injections of intramuscular Progesterone should be offered or used commencing in gestational weeks 16 through 20, and continuing through delivery or week 37.

In this case, despite her history of multiple preterm deliveries, the infant's mother was never offered, prescribed or given intramuscular progesterone injections. The law firm argued that the obstetrician and midwife practice should have used Progesterone in an effort to prevent the preterm delivery of the infant, and that the failure to do so caused or contributed to the preterm birth of the infant and the resulting injuries.

The case settled in an upstate New York county prior to jury selection. In addition to the monetary award, the settlement includes the payment of medical care for life for the child, for the treatment of any injuries related to the claim.
