MINEOLA, N.Y. - Oct. 9, 2024 - PRLog -- Ready, Pascale & Gennarelli, P.C.'s client, a union electrician, was injured while attempting to pick up a 50-pound jack from the floor of a storage room at a construction site in New York City. As the worker was lifting the jack, his foot slipped on an accumulation of water and debris on the floor which caused him to fall.

As a result of the fall, the worker sustained a herniated disc in his lumbar spine which required him to undergo two back surgeries including the removal of a portion of a herniated disc and subsequent fusion of two vertebrae. He was out of work for approximately 4 years.

Owners and general contractors at a construction site have a duty to keep workers safe from hazards on the job. This includes keeping work areas free of slippery conditions and tripping hazards. The failure to do so subjects them to liability.

The defendants sought to resolve the case through a non-binding mediation prior to trial. However, the amounts offered to settle the case at that time were insufficient, and RPG prepared the case for trial. On the eve of trial, and shortly before jury selection, RPG's Mr. Gennarelli was able to settle the case for $2.5M.
