Reformulation of Chemicals in Consumer Products under California Proposition 65

SGS reports on multiple settlements for a variety of consumer goods containing Proposition (Prop 65) listed chemicals in California, many of which allow a Prop 65 warning as a substitute for removal.

GENEVA - Jan. 24, 2025 - PRLog -- SGS, the world's leading testing, inspection and certification company, has published SafeGuardS 009.25 to keep stakeholders informed on multiple settlements for a range of products containing California Proposition 65 (Prop 65) listed chemicals.

First published in 1987 and updated at least once a year since, California's 'Safe Drinking Water and Toxic Enforcement Act', also known as Prop 65, requires the state to publish a list of chemicals known to cause cancer, birth defects or reproductive harm. The list now includes approximately 900 chemicals.

Companies trading in California must provide a clear and reasonable warning before knowingly and intentionally exposing anyone to a chemical listed in Prop 65. Failure to comply after 12 months without an exemption may result in legal action.

SGS experts publish SafeGuardS to inform stakeholders about regulatory changes that could impact their business. SafeGuardS 009.25 includes summaries of multiple settlements for a range of substances, including:
- Bisphenol A (BPA)
- Lead One or more phthalates
- Lead and phthalates
- Chromium (VI) compounds
- Perfluorooctanoic acid (PFOA)
- Cocamide diethanolamine (cocamide DEA) and diethanolamine (DEA)

It should be noted, many of the settlements allow a Prop 65 warning as an alternative to removing the listed chemical from products.

Prop 65 settlements are consent agreements between named parties and unnamed parties are not bound by them.
