Judge Throws Out Most of Z-Ultimate Legal Claims Against United Studios of Self Defense

On August 19, in a lawsuit between United Studios of Self Defense (USSD) and Z-Ultimate, an Orange County judge threw out three causes of action that had been levied against USSD.

Aug. 22, 2011 - PRLog -- IRVINE, CALIF.--On August 19, in a lawsuit between Irvine-based United Studios of Self Defense (USSD) and Z-Ultimate, an Orange County judge threw out three causes of action that had been levied against USSD.

   Superior Court Judge David Chaffee ruled that there was no basis for claims by Kris Eszlinger and his Z Ultimate colleagues Hans Prosch, Frank Ley, William Clark and Paul Taylor that alleged USSD's contract interference, interference with prospective economic advantage and invasion of privacy. "Nothing they submitted to the court could justify these claims so the judge dismissed them," says Lawrence J. Conlan, USSD co-counsel with A. Barry Cappello of Cappello & Noël, LLP.

   "Eszlinger and his cronies have been trying to plead these claims for almost a year and they were unable to do so," notes Conlan. "With the claims dismissed, the only remaining damage claim is for slander. We consider this a weak claim, especially in light of the smear tactics used by Z-Ultimate against USSD. The tables have definitely turned, as we knew they would. Z-Ultimate is on the defensive and isnow left to contend with USSD's serious claims against it. This is only the beginning."

   While asked to comment on this strategic victory, Charles Mattera, USSD founder, said "I can't help but to sympathize with USSD investors, instructors and most of all students who were forced from USSD to Z-Ultimate against their will."
