White Stone Group (Case Number: 1:2011cv03349) In this collective action lawsuit, the Security Guards allege that The White Stone Group and White Stone Staffing violated the Fair Labor Standards Act by failing to properly compensation them for overtime hours. Morgan and Morgan overtime attorney Andrew R. Frisch is representing the Security Guards in an effort to recover unpaid wages for the overtime work they performed, but for which they did not receive the proper overtime pay. According to a federal law known as the FLSA, non-exempt employees are entitled to time-and-a-half pay for all hours worked over forty in a given workweek. Previously, The White Stone Group settled a similar lawsuit in Ohio that had been brought by the Department of Labor (“DOL”). Under the terms of the Consent Agreement reached between the DOL and White Stone, to settle the prior case, White Stone promised to abide by the Fair Labor Standards Act’s overtime regulations. However, this lawsuit alleges that notwithstanding their prior agreement White Stone has continued to flout the FLSA’s requirements. All unpaid overtime claims filed by Security Guards who worked for White Stone Group within the last three (3)years and whom were not paid proper overtime are eligible to join the case.
