The Incident of the excessive force used against John and the physical assault against him occurred on February 22, 2015, and at about 4AM; in the City of NY, county of Kings - and within a holding cell within PSA-2, located at 560 Sutter Avenue, Brooklyn, NY 11207. John had been in police custody after having been arrested and charged with AC 10-12B 00, open container. After spending almost two (2) hours at the precinct, he asked an NYPD officer if he could use the restroom. His request was denied and so about forty-five minutes later he asked again, but was told, "Well, the cell isn't wet yet, so you must not have to go that bad." Soon thereafter, he was forced to urinate on the floor of the cell. Next, an NYPD officer opened the cell door and let the other individual in the cell with John out. John then watched as the officer twisted the camera away from the cell before physically assaulting him by twisting the thumb of his left hand. In excruciating pain, he was taken to Brookdale Hospital where a cast was prescribed.
