Client Charged with Hit and Run Has All Criminal Charges Dismissed

NEW YORK - Oct. 10, 2017 - PRLog -- The firm's client was criminally charged with Leaving the Scene of an Accident without Reporting, with Personal Injury; which is sometimes referred to as a "Hit and Run." The individual who made the complaint against the firm's client alleged that the client's car struck her as she crossed the street, causing substantial pain to her back. It was also alleged that the firm's client then drove away without reporting the Incident and without providing her name, insurance information or otherwise identifying herself.

Once the law firm was retained, a proffer session was arranged with the ADA handling the case. Such a proffer session is sometimes referred to as a "Queen for a Day" meeting with the prosecutor. In this scenario, the criminally charged defendant and their lawyer meet with the prosecutor. The prosecutor will listen to the client's version of events related to the Incident and the prosecutor will also ask questions. As long as the client is truthful, their statements are not supposed to be used against them later if the case ultimately were to go to trial.

Following the proffer session, the prosecutor made contact with the individual who claimed that the firm's client hit her with her car and fled the scene. Ultimately, the prosecutor determined that the firm's client had not left the scene and had immediately reported the Incident to her insurance company. The prosecutor also determined that the individual who was struck did not stay at the scene and was mostly interested in pursuing a civil lawsuit seeking money damages. All criminal charges lodged against the firm's client were dismissed on motion of the Manhattan District Attorney's Office.
