Follow on Google News | Amended Complaint Filed in Lawsuit Alleging NY Carpenters Denied Prevailing WagesWithin the Amended Complaint, the carpenters allege that they performed work at locations including the United States Post Office located in Farmingdale, NY; Queens Museum and Fort Dix Army Base, located in Burlington County, New Jersey. Although the contracts entered into by the construction companies and the governmental instrumentalities required that the carpenters receive prevailing wages for their work, they did not receive prevailing wages, supplemental benefits or fringe benefits. Volmar Construction, Inc. was added as a defendant because they were the general contractor on these projects and, the Complaint alleges, are liable for the subcontractor's failure to pay the workers as required by the contracts. The Amended Complaint also adds breach of contract and third party beneficiary causes of action because the carpenters were the intended recipients of the wages they were contractually required to receive as part of the government works. The Amended Complaint goes on to allege that the general contractor's and sub-contractor's failure to pay the NY carpenters prevailing wages and benefits as required by the contracts they entered into with the government, constituted a material breach of those contracts, entitling the carpenters to recover said wages. Finally, the carpenters allege that the sub-contractor violated New York Labor Law record keeping requirements and failed to provide the carpenters with accurate wage statements as required by law, entitling them to further damages.
